Terms & Condition- Paid/Barter Collaboration
FAFO India PVT LTD- Influencer Collaboration Terms and Conditions
Introduction: By entering into a collaboration agreement with FAFO Clothing Brand ("FAFO"), you ("Influencer") agree to abide by the following terms and conditions.
Scope of Collaboration: The collaboration may include but is not limited to social media posts, blog content, product reviews, and any other mutually agreed promotional activities.
Content Creation: Influencer agrees to create original and authentic content that positively represents FAFO and its products. Content must adhere to FAFO's brand values and guidelines.
Product Exchange/Compensation: The collaboration may involve either product exchange or collaboration.
In case of monetary agreement, FAFO may ask to return the product. In such cases the product needs to be purchased first and amount will be refunded as soon as the return is received, and no voluntary tampering/intentional damage done with the product.
In case of Barter collaboration, the product needs to be purchased first and amount will be refunded as soon as the content is delivered.
Timelines: That deliverable must be met in promised timeline.
In case of barter collaboration, the refundable product amount can be reduced by 10% every 3 days the timeline is not met.
In case of monetary agreement, the payable amount can be reduced by 10% every 3 days the timeline is not met.
Use of Content: FAFO retains the right to repost, share, or otherwise use the content created by the Influencer for promotional purposes. Any videos/ images/ blog or content created as part of collaboration is intellectual property of FAFO INDIA PRIVATE LTD and influencer will not contest for any IP rights.
Confidentiality: Both parties agree to keep any confidential information shared during the collaboration confidential and not disclose it to any third parties without prior written consent.
Termination: FAFO may terminate the collaboration immediately if Influencer fails to comply with these terms and conditions.
Indemnification: Influencer agrees to indemnify and hold FAFO harmless from any claims, damages, liabilities, or expenses arising out of or in connection with Influencer's breach of these terms and conditions or violation of any applicable laws or regulations.
Governing Law: This agreement shall be governed by and construed in accordance with the laws and any disputes arising under or in connection with this agreement shall be subject to the exclusive jurisdiction of the courts of Pune, Maharashtra.
By entering this collaboration, both parties acknowledge that they have read, understood, and agree to be bound by these terms and conditions.
